1. Eligibility
Our services are available to individuals aged 18 or older.
By signing up, you confirm that you meet this age requirement and are legally able to enter into binding agreements.
2. Services Provided
We offer triathlon coaching services, including custom training plans, one-on-one coaching, virtual coaching, and pre-made training plans.
Services may be delivered online, in person (where applicable), or through third-party platforms such as TrainingPeaks.
We reserve the right to modify, pause, or discontinue any service at any time without notice.
3. Payments & Refund Policy
All payments must be made in full before services are provided.
Unless otherwise stated in writing, all sales are final and non-refundable.
Pricing is subject to change at our discretion.
4. Health & Medical Disclaimer
Our coaching programs and plans are intended for healthy adults.
You should consult your physician before starting any exercise or nutrition program.
You acknowledge and agree that participation in endurance sports carries inherent risks, including but not limited to injury, illness, or death.
You voluntarily assume all risks associated with training and racing.
5. Liability Waiver
To the maximum extent permitted by law, Progress in Motion LLC, its coaches, and affiliates are not liable for any injuries, damages, losses, or claims resulting from participation in our coaching services.
You agree to release, indemnify, and hold harmless Progress in Motion LLC, its owners, and its coaches (including Kyle Barger and Evan Davidson) from any claims related to your participation.
6. Intellectual Property
All training plans, guides, videos, and resources we provide are protected by copyright.
You may not share, copy, distribute, or resell our materials without written permission.
7. Client Responsibilities
Provide accurate and complete personal and medical information when requested.
Follow your training plan as advised and communicate any injuries, illnesses, or changes in health.
Maintain your TrainingPeaks account (or other agreed platform) for plan delivery and communication.
8. Cancellations & Rescheduling
Any scheduled calls or in-person sessions must be canceled or rescheduled at least 24 hours in advance.
Missed sessions without notice will not be refunded or credited.
9. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania.
Any disputes will be resolved in the courts located within Pennsylvania.
10. Media Release
By participating in our coaching services, you grant us permission to use photographs, videos, testimonials, and race results for marketing purposes, unless you notify us in writing that you do not consent.
11. Changes to Terms
We may update these Terms & Conditions from time to time. Updates will be posted on our website with a new effective date.
